Monster Energy Drink vs Vermonster Beer

Here is another classic case of David picking on poor Goliath again. I am sick of small family run businesses who think they can start a business in their basement, work hard, pay their bills and save enough to finally move into a warehouse and hire 7 other people who think they deserve to make a living by working hard and taking pride in what they do.

On top of that this little start up known as the Rock Art Brewery go and trademark their Beer in the state of Vermont using the name Vermonster. They think I will think that this is a clever spin on their state of Vermont name. Not so - the moment I heard it I was immediately confused as to whether it was a Monster Energy Drink and even though it doesn't look like an energy drink, or smell like one, or have the same labeling or packaging I was pretty sure it wasn't a Beer and must have been a Monster Energy Drink.

And get this - they are refusing to cease and desist using the name Vermonster on their beer even after poor huge Billion dollar energy drink conglomerate Hansen Beverage Co asked them to stop because while Hansen doesn't make a Beer but does make Monster Energy Drinks they are concerned that they won't be able to make a Monster Beer in future because Vermonster will confuse consumers.

Just because Vermonster has a beer and produced beer first is no excuse for harming poor little huge Hansen Beverage Co and I urge my readers to use the net in any way you see fit to bury this little upstart that dares to get in the way of Corporate America.

I think all we have left is to rank one of our commynitys blogs #1 in google for Monster Energy Drink, with a post like this... Anyone up for the challenge? :P

I seriously hate stuff like this.I am in the process of starting a business of my own - internet marketing - and even though it is not going to be branded, but instead I will just keep on building websites for me, I would not be hurt by something like this. But I definitely feel for someone who puts his life to build a business and make a brand, and ends up possibly getting run over like this by some asshole company.

I smell something bigger brewing here, like social justice. I can't imagine if this continues Monster will continue with this process which I hope it does not. Ford adverted a situation very similar to this last year it will be interesting to see how Monster handles this issue.

I was also taken in by Rock Art's naming chicanery. I am extremely offended by their clever use of subterfuge in naming their product to ride on the coattails of Monster Energy and trick me into buying a product I did not want.

I plan to pursue lawsuits against Rock Art Brewery for tricking me in this fashion and against myself for being a total jackass.

This happens so many times, you would think anyone incorporating a business would seek better advice and undergo more extensive research. This is why copyrights exist.
Hindsight aside, I admire this guy for sticking to his guns. However, at what cost? If he loses the business and his family suffers because he is too stubborn to change the name and STILL have a successful business, Monster wins. They may win anyhow, but is this the hill he wants to die on? It may not be a case of selling all principles, just backing away from one battle to win the war.

Ahem... maybe somebody should let Monster Cable know that somebody is using the word "Monster" on an energy drink. Monster cable is notorious for suing small mom and pop companies for the using the word "Monster" in their name... look it up. Possible we could have Monster Energy drink and Monster cable (2 very big companies) spew through a chunk-o-cash until one of them cries uncle.

Seems to be aimed at the youthful, hip and tasteless crowd as it is apparently made out of Diesel byproduct mixed with dromedary urine. People spent a billion dollars on it last year so maybe I am just an old fart and out of the loop.

Aah, Corporate America...
At the top of the list are the insurance companies, banks, and credit card companies, followed by billion dollar corporations such as Monster Energy Drinks -- the subject matter of this interesting post.
The genesis of these de facto entities establishing and gaining power in Corporate America began in 1938 when the case of Erie Railroad v. Tomkins was decided by the United States Supreme Court. From that point forward it has become progressively harder for the little businesses such Vermonster to gain an even foothold in any civil litigation that may ensue by Monster Energy Drink; who purports that their copyrighted name is being infringed upon... To me it is just a case of semantical gymnastics, but the Vermonster Trademark simply may become a piece of history because truly they should have known better than to mess with a giant in the first place.
Clearly, this case will make its way through the American court system and someone will loose.
Remember, the pen is mightier than the sword, and Monster Energy Drink has a right to their day in court...

-yeah, in business any publicity is good publicity except for Hansen. This publicity will surely help this small business sell way,way more Vermonster beer than they would have without the media pub. My guess is he'll quit fighting them after Hansen helps put him on the map.

I wonder what would happen if we all called their 800 number, left a voice mail message. The poor bastard that has to respond to the voice mail in the morning might be pissed off.

Imagine as the person checks the messages in the morning saying you have 5000 voice mail messages, press 1 to retrieve them...lol..Evil grin and wink wink guys.....:)

Apparently they drank too much Rockstar (oooh, low blow) and got a little keyboard happy. I'm not a lawyer, and I don't play one on TV, but Hansen may be picking on Vermonster because they have to. Somewhere in the back of my mind I recall something about trademarks going back into the public domain if not defended. In other words, even if Vermonster doesn't produce confusion, the precedent weakens Hansen's case for future lawsuits where the infringement is more serious.

I've 'rant' about a guy who go against my previous employer, a Giant Pharma Company by the name of Pfizer, and took 6 years before he justice took on his side.
6 bloody years my friend and the reward - USD 2.3 Billion! Music to the ears...

*lol* Love it! Griz, you're showing up as #8 for Monster Energy (not counting the image results line), or #6 if you don't count the news and shopping results.

Allyn is page 2 for Monster Energy Drinks, and page 3 for Monster Energy Drink.

Also, apparently Continental Enterprises has also started bullying an actor who was in a photo wearing a monster costume and holding a monster drink: http://techdirt.com/articles/20091020/1237266605.shtml Beautiful. Amazing, isn't it? You really can turn your school yard bullying skills into a real world business!

It's amazing how the social media sites like FaceBook, along with that senator, got all the credit. It couldn't have had anything to do with all the IM'ers creeping into page 1 of of Google, could it?

I think the reason Grizz threw up this post is because he wants to make more money. Am I right Grizz?

What I mean specifically is that when search engine traffic from newbies trying to find a get rich quick plan come across this site and just see a totally unrelated Monster Energy drink post they'll be more inclined to click on one of Grizz's ads to get off this page and try to find what they (think) they're looking for than if they came across one of his truly informative posts with a catchy title that would address what they're searching for.

If the front page had a title like: "Why the SEO and Social Media Industry Will Hurt You" then websurfers might be interested in reading on to find out exactly why - especially since the title goes against everything they've been told. Those readers will stick around and not click on ads. They might even become regular readers (like myself).

Another brilliant experiment by Grizz.

(obv. these are no-follow links but I still wanted to have a name that stands out)

Well,i agreed.There are lots of small and medium enterprises being setup nowadays from many professions.There are tendencies to have businesses who are out for a quick bucks.

This is a case of a brand name that had been used on a product that does not live up to the expectation.There should be a governing body to monitor it.

As an owner of an energy drink company myself,and we started with nothing, really almost nothing under $20,000 investment total.

We went the process of trademarking (Xfuel) and were awarded the mark. There are other companies out there clearly infringing on us and at some point we will have to do the same as Monster is doing.

Although I am not a fan of the Monster (Hansen) product, they have been in business for many, many, many years and have paid their dues and went the legal route.

What these people did is wrong,they are trying to cause confusion in the marketplace.

If they were truly Amercian business people they would have researched this a little more and gotten a name that is unique to them and not copy Monster - what they are doing is exactly what people accused the Japanesse of and now the Chinese which is knocking off Amercian companies!

Griz, howhub could have some great potential. My thoughts are that I start with a blogger with a "super keyword" in mind as well as one I try to get ranked for. The blogger is the "money site", then there may even be some other money sites using blogvis, blogsome, blogetery, etc.

However, then in that niche write all sorts of articles about it targeting different keywords. Using hub pages, infobarrel and Howhub, etc, build several backlinks to the money site. Then use hub pages infobarrel and howhub to build backlinks for those backlinks, which will act as the blog farm, but will actually be legit. If you have additional adsense accounts and you want you can build blogfarms to those, or supporting sites and then blog farms, but I am going to keep it legit for the most part. Might submit a handful of the same articles to other article directories for supporting links to each of those sites, but I'm getting money from these sites, so there's much more reward in building backlinks.

Basically I'd follow your method and the method Janet outlined in her book.
I think Howhub is a very cool resource. if you click on my name, you can go to the site, but in howhub it's 50% commission... HOWEVER, if you refer 10 people you get 100% adsense commission even if you've already written several articles. If anyone wants to signup through me click on my name... I realize this is somewhat spammy, but I really think that people will bennefit from using howhub, hubpages, and infobarrel to build articles around, rather than building links from sites where they aren't getting revenue.

Also, I wanted to ask if there's anymore sites like infobarrel, hub pages and how hub that you know of with revenue sharing article directories? I think blogvis and blogetery you can pay money to be a supporter and if so you get full revenue, but that's more of a blog site.

If you have made it this far down the page then I assume you might just be serious about learning how to make a real sustainable living online - as opposed to the thousands of visitors I see daily looking for that "get rich quick" miracle that really doesn't happen without a winning lottery ticket.

You have probably figured out by now that you aren't going to find the answer in a $47 ebook or by following your favorite twit on twitter.
